DMCA & copyright policy.
1. Scope
This policy applies to copyright complaints regarding content hosted on the SweetNote B2B platform, primarily Customer-supplied video creative served via reveal pages. Trademark, defamation, and other content disputes are handled through the AUP procedure in the MSA rather than this DMCA workflow.
2. Designated Agent for DMCA notices
Pursuant to 17 U.S.C. § 512(c)(2), The Sweet Note, Inc. is registered as a Designated Agent with the U.S. Copyright Office DMCA Designated Agent Directory (Agent ID DMCA-1074369; the full record is publicly searchable in the directory). The canonical contact for notifications of claimed infringement is the Designated Agent below:
The Sweet Note, Inc.
526 Calle Cuervo
Arroyo Grande, CA 93420
Phone: (661) 246-8138
Email: lauren@thesweetnote.com
Registered with the U.S. Copyright Office DMCA Designated Agent Directory at copyright.gov/dmca-directory (Agent ID DMCA-1074369; effective June 18, 2026). Send all notices of claimed infringement to the contact above.
SweetNote will maintain its Designated Agent registration in good standing and will renew it with the U.S. Copyright Office at least once every three years (or on the Office's then-current renewal cadence), as required to preserve the safe harbor under 17 U.S.C. § 512(c).
3. Filing a DMCA notice
If you believe content hosted on a SweetNote reveal page infringes a copyright you own or are authorized to act for, send a written notice to the Designated Agent above (or via dmca@thesweetnote.com) that includes:
- An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
- A description of the copyrighted work that you claim has been infringed.
- The URL of the specific reveal page (or other location) on the SweetNote platform where the allegedly infringing material is located.
- Your contact information, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Knowingly material misrepresentations in a DMCA notice may result in liability under 17 U.S.C. § 512(f).
4. SweetNote's response
On receipt of a complete DMCA notice, SweetNote will:
- Acknowledge receipt within two business days.
- Promptly disable access to the allegedly infringing material on the affected reveal page (typically within five business days, sooner where harm is plausible and immediate).
- Notify the Customer (the brand whose campaign hosts the affected video) that a notice has been received and that the material has been disabled, including a copy of the notice.
- Document the take-down decision in the order's audit log.
Disabling access is not an admission of infringement; it is a good-faith response to a notice meeting the statutory requirements.
5. Counter-notice
If Customer believes the disabled material was disabled in error or as a result of misidentification, Customer (or the affected sender) may submit a counter-notice to dmca@thesweetnote.com. The counter-notice must include:
- An electronic or physical signature.
- Identification of the material that was disabled and its prior URL.
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement consenting to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located (or, if outside the U.S., for any judicial district in which SweetNote may be found), and that you will accept service of process from the original complainant.
On receipt of a complete counter-notice, SweetNote will promptly forward it to the original complainant and will restore the disabled material on the fourteenth (14th) business day following receipt of the complete counter-notice, unless SweetNote has by that day received notice from the complainant of a filed court action seeking a court order to restrain the affected Customer or sender from engaging in infringing activity relating to the material at issue. Restoration is automatic at that mark and does not require any further action by Customer; this single-clock procedure runs from receipt of the counter notice, within the not-less-than-10, not-more-than-14-business-day window set by 17 U.S.C. §512(g)(2)(C).
6. Repeat infringers
SweetNote will, in appropriate circumstances, terminate the SweetNote service for Customers who are determined to be repeat infringers. A Customer is presumed to be a repeat infringer where SweetNote has received two (2) or more DMCA notices in any rolling 12-month period that resulted in takedown of Customer-supplied content (i.e., notices that were not withdrawn, dismissed as defective, or successfully counter-noticed). The presumption is rebuttable: Customer may demonstrate that the notices reflect distinct senders or one-off rights disputes that have since been resolved. Determination otherwise follows the AUP procedure in the MSA: notice, opportunity to cure or contest, and (where unresolved) suspension or termination.
